well what a let down at 5.30 last night to be told by our solicitor we can not complete as Polaris have not got the habitation certificate!! snagging was taking place today and completion should of been on Monday. We are not completing on Monday on the advise of our solicitor but we did go ahead with the snagging which to our surprize went really well. Only a bit of overspray on the front door and a really dirty toilet arh!!! where's the domestos bleach!!
Got home from Murcia and went straight the pub and had a LARGE vodka!! to drown my sorrows lol!! hic hic!! :(

Sorry for being dim, what is the habitation certificate, and is it for people who are intending to live in Spain, or do you need one even if you're using it as a holiday home ?

Hi Carla

HAbitation Certificates are issued by the Town Hall to confirm that the property is fit to be lived in, similar to the ones builders have to get on new properties in the UK. We had exactly the same problem as scouser when we completed on our appartment in the Jardines de Alhama in July. We got a call from our lawyers two days before we flew out to complete. Polaris World then had to pay for us to get a Power of Atorney set up though as we weren't going to be about when the completion went through.
The problem we were advised was that there is only one inspector who has to look at each individual property. He then does a report which is dicussed at a weekly meeting, only then will the Certificate be issued. I'm sure the wee man must be demented given the amount of properties Polaris try to complete on, hence the constant delays. It took an addition three weeks for our Certificate to come through, not sure how long the delay is at the moment.
If you check out the Jardine's Forum, we've been competing since about April so you can see some of the issues we've been having during the completion process.

Same story here.
Not too fussed though, as said before Polaris are paying for it to be done by power of attorney so all will be done eventually. Saves us having to go back to sort it anyway.
Had major problem with the snagging as the rear part of the roof terrace had collapsed into the back bedroom.

LOL - only joking.
Just a few minor things, overpainting, scratch on worktop, doors sticking. Nothing major.

Hi ....staying in Lo Pagan for snagging and Completion on Thursday/Friday had phone call this afternoon from our Solicitors, and Habitation Certificate not done either........so there will be a few of us by the look of things. Very dissapointed, but snagging still scheduled for 9 a.m. obviously it will be a power of attorney job for completion now. Why do P.W. get you all set up for your visit and not let you know before you fly out, so that you can reschedule snagging/completion as well as hotel accomodation/hire car and of course flights. Shoddy really, they could have let us know last week.......spoiled things a bit for us, they should have done better. :(

Sorry must have brain fog with all the info I'm trying to take in at the moment, we have been waiting since October 3rd for our HC, others especially in the penthouses have had their dates from October put off now till December. If what you say about having only one inspector is correct, I would have thought that at least a few properties on Naranjos would have had theirs by now, but there doesn't seem to be any sign. Thank you for any information. June

Just to put a spanner in the whole - no habitation certificate debate.

Similarily I was out with my brother to complete last week and again no habitation certificate. Our solicitor had a more relaxed view of the situation based on the following:

The Builder (PW) first has too get a project architect to agree to the overall design etc of the overall and individual dwelling within the project. He applies for a licence to build from the Town Hall and gains a bank guarantee to the town hall to cover the finalisation of the infrastructure.

PW then contracts an insurance company to underwrite the project. Once PW has completed the works on a dwelling he gets the architect a certificate of finalisation of the works. The Architect will only issue this once the building has been constructed to their satisfaction as he retains liability. PW then obtains from the insurance company a 10 year guarantee insurance much like our NHBC 10 year gtee.

PW then goes to the notary once he has all the documentation proving the dwelling has been built in accordance with all the specifications of the architect along with the certificate of finalisation to sign the finalisation of works (Final de obra). Once the Final de Obra is issued PW applies to the town hall for the Cedula de Habitabilidad. This enables the electric and Gas to be connescted.

Based on this and confirmation that the Final De Obra had been issued for our property and in the knowledge that other properties on Jardines had been signed off by the Town Hall our Solicitor in Spain was confident in recomending that we complete and he would then follow up with the rubber stamping of the Habitation Certificate.

Hence we snagged on the 15th and completed on the 16th ........and as I write this I have just received a call from Polaris asking permission to enter our apartment with the architect and town hall official for the purpose of issueing the habitation certificate.

If there is any issue tomorrow then I will write a very strong retratction telling everyone not to complete without the certificate!

Fingers crossed.

Hi everyone, had email from PW today saying that whilst they don't have the habitation certificate for us ( Los N 7 ) they do have them for Jardin 1 - 4. They can't give us an exact date for ours, but they think it will be soon. We are still going through with our completion today, without it. We know from our solicitor that PW have all the other certificates they should have and so, it is just waiting for the town hall to catch up with the back log. It's driving me crazy waiting for the news that completion has gone through

Just been informed by our solicitors that they have recieved the habitation certificate from polaris today. We are on Jardin 4, not completing untill end of November, so looks like we are set to go.

That's great news Mozba will have to get onto our solicitor, this final bankers draft is burning a hole in me pocket, had to ask the bank how long it was valued for as I do not want to pay another 150 euros for a new bankers draft not to mention the interest lost over the last three weeks!!

Due to complete Los Naranjos 2 on 25th November, and the completions dept at PW have just scanned over a copy of the Habitation Certificate via email. Phew, at least it has arrived before completion!!!

we are block four N218 and we have friends in the penthouses block 12 but have still not got there's and they did their snagging same day as us using same solicitor too.

Update on earlier post......

we took the risk and completed without Hab Cert in place, although we did ensure all the paperwork had been lodged with the Town Hall.

Hab Cert now recieved and all was fine - some 'well informed' gambles do pay off!

just heard from polaris today, they were asking for entry into my appartment tomorrow so they could give the person who issues the habitation certificate access, hope all goes well,
