Just to put a spanner in the whole - no habitation certificate debate.
Similarily I was out with my brother to complete last week and again no habitation certificate. Our solicitor had a more relaxed view of the situation based on the following:
The Builder (PW) first has too get a project architect to agree to the overall design etc of the overall and individual dwelling within the project. He applies for a licence to build from the Town Hall and gains a bank guarantee to the town hall to cover the finalisation of the infrastructure.
PW then contracts an insurance company to underwrite the project. Once PW has completed the works on a dwelling he gets the architect a certificate of finalisation of the works. The Architect will only issue this once the building has been constructed to their satisfaction as he retains liability. PW then obtains from the insurance company a 10 year guarantee insurance much like our NHBC 10 year gtee.
PW then goes to the notary once he has all the documentation proving the dwelling has been built in accordance with all the specifications of the architect along with the certificate of finalisation to sign the finalisation of works (Final de obra). Once the Final de Obra is issued PW applies to the town hall for the Cedula de Habitabilidad. This enables the electric and Gas to be connescted.
Based on this and confirmation that the Final De Obra had been issued for our property and in the knowledge that other properties on Jardines had been signed off by the Town Hall our Solicitor in Spain was confident in recomending that we complete and he would then follow up with the rubber stamping of the Habitation Certificate.
Hence we snagged on the 15th and completed on the 16th ........and as I write this I have just received a call from Polaris asking permission to enter our apartment with the architect and town hall official for the purpose of issueing the habitation certificate.
If there is any issue tomorrow then I will write a very strong retratction telling everyone not to complete without the certificate!
